GENERAL TERMS AND CONDITIONS
1. GENERAL NOTES
All the following Terms and Conditions refer to all the services provided by Best Tuscany Tours by NCC Firenze di Leonardo Mura, these apply to passenger transport for occasional, continuous services and to all excursions with cars. The same also apply to all other commercial relations relating to transport, so it is not necessary to specifically agree them through further bookings. Changes to the Terms and Conditions are reserved.
2. OBJECT OF THE CONTRACT / CONCLUSION AND EXCLUSION OF TRANSPORT
2.1. Best Tuscany Tours by NCC Firenze di Leonardo Mura will be able to accept travel bookings by phone, email, text message in writing or online under the current conditions printed on any brochure or published on its website. However, the service will be confirmed in both cases where the contractor has confirmed the same either before the service or after the service actually started. 2.2. The object of the reservation is the transport of people to the booked locations with possible waiting for the driver. 2.4. Complaints arising from any inefficiencies must be submitted by email within three (3) days and no later than the date of the term of the service.
3. PRICES
Transport prices do not include any costs for waiting for the driver unless previously agreed. All prices are, unless otherwise indicated, expressed in EURO and include VAT.
4. PAYMENT TERMS
The rate is due at the end of the service and charged by credit / debit card or, if the expense does not exceed the maximum cash payment limit provided for by current Italian laws, in cash or by bank transfer for advance payments. Exceptions are only bookings for which a different written agreement has been made in advance. For bookings of services involving amounts over € 1,000.00, the customer undertakes to pay a deposit of 50%. The balance of the remaining 50% must be paid at the end of the service directly to the driver by credit / debit card * or within the terms previously agreed by bank transfer upon invoice. Invoice payments by bank transfer must be paid to the bank account indicated on the invoice or made at the end of the service by credit / debit card *. Credit and debit cards * are accepted on all vehicles of Best Tuscany Tours by NCC Firenze di Leonardo Mura. Cash payments are allowed, provided that a maximum amount of € 2,000.00 (until 31 December 2020) and € 1,000.00 (from 1 January 2021) is not exceeded, as required by Italian laws in force. 5. CANCELLATIONS
If the customer were to withdraw from the agreements previously stipulated and therefore had to cancel the services with our company, Best Tuscany Tours by NCC Firenze di Leonardo Mura has the right to generate a claim for damages. If one or more services, agreed in advance, are not used or canceled within the established terms, the customer must pay the full price of the previously agreed service without any reduction. If one or more services, agreed in advance, are canceled, the deposit (20% of the total price) will not, in any case, be refundable. If the cancellation occurs:
• 15 days before the start of the service, the penalty is 0%
• from 14 days to 7 days before the start of the service, the penalty is 50%
• from 6 days to 1 day before the start of the service, the penalty is 75%
• Less than 24 hours before the start of the service, the penalty is 100%
6. OBLIGATIONS AND RESPONSIBILITIES OF THE CUSTOMER AND EACH PASSENGER
The duty of each passenger is to follow the good behavioral rules in force inside our vehicles, for their safety, the safety of our driver and other people inside the passenger compartment. For safety reasons, the driver's instructions must always be respected. The passenger is responsible for complying with the obligation to sit in his seat, as well as for supervising and guaranteeing assistance to the minors associated with him, to ensure protection for any animals accompanying him. Customers must ensure that minors traveling with them open the doors only after the driver's authorization. Customers and companions are still required to check whether it is possible to open the doors does not cause danger. In case of damage, customers and accompanying persons are responsible for it. Damage to vehicles caused directly or indirectly by the customer and / or passenger through negligence or due to existing behavioral rules not respected within our vehicles will all be borne by the customer. Any dirt detected inside the vehicle caused directly or indirectly by the customer and / or passenger, the customer will be charged separately for the extra cleaning costs.
7. WARRANTY, LIABILITY AND LIMITATION OF LIABILITY
7.1. Suitcases, bags and other containers, even if correctly positioned in the vehicle, could be subject to natural wear during transport and in this case Best Tuscany Tours by NCC Firenze di Leonardo Mura is not responsible for them. Any damage to the paint of bicycles, wheelchairs, baby carriages or other transported material relieves Best Tuscany Tours by NCC Firenze di Leonardo Mura from any liability, especially if the positioning of the same inside the vehicle has been previously approved by the customer. It is also not the responsibility of Best Tuscany Tours by NCC Firenze di Leonardo Mura the content of the luggage transported if this is not in any way permitted by law (e.g. drugs, etc.) and it will be the customer himself who will answer directly to the authorities. police officers who have detected their presence during a possible control.
7.2. Any complaints regarding any damage to suitcases and other material transported must be brought to the attention of Leonardo Mura's Best Tuscany Tours by NCC Firenze immediately at the end of the trip.
7.3. Customers are responsible for any personal injury or damage to the vehicle and / or other transported persons resulting from the consumption of tobacco, alcohol or food which are strictly prohibited inside the vehicle.
7.4. The customer is responsible, within the scope of the provisions of the law, for damage to property or personal injury caused by himself. This also applies to damage to vehicles owned by Best Tuscany Tours by NCC Firenze di Leonardo Mura or third parties caused by reasons of negligence on the part of accompanied minors, animals or goods transported. This also applies in particular to damage caused by vomiting, incontinence, food or products leaking from their containers. In order to quantify such damages, the contractor will assert not only the elimination but also the loss of profit due to damages caused by the latter.
8. PRIVACY

9. JURISDICTION
In the event of a dispute between the parties concerning the interpretation and / or execution of this contract, the competent court is exclusively that of Florence.
10. SALVATORY CLAUSE
Should individual provisions of these Terms and Conditions prove to be void, ineffective or impracticable, the validity, effectiveness and compliance of the remaining parts of these Terms and Conditions remain unaffected. The null, ineffective or unenforceable clause will be replaced, with ex tunc effect, by an effective provision whose economic purposes are as close as possible to what is desired by the parties.
